High Court Judges Rule Housing Levy is Constitutional

A three-judge bench has ruled that President William Ruto’s housing levy is constitutional, delivering a significant win for the government’s Affordable Housing Act. The ruling, made on Tuesday, 22 October affirmed the legality of the 1.5% levy imposed on employees’ gross monthly salaries.

The decision was delivered by Justices Olga Sewe, John Chigiti, and Josephine Mongare, who reviewed six consolidated petitions challenging the levy. The judges ruled that the housing levy was enacted according to the Constitution, adding that there was adequate public participation in the process.

Busia Senator Okiya Omtatah, was among those who questioned the legality of the Affordable Housing Act. Chief Justice Martha Koome had appointed the three-judge panel to hear the case, which has now dismissed the petitions challenging the levy’s implementation.
